Form 7 Tenancy Claim

A Form 7 is an application by a cultivating tenant for occupancy rights under the Karnataka Land Reforms Act, and a granted or pending claim can defeat the recorded owner.

The Act abolished tenancy and vested occupancy rights in tenants who applied through the Land Tribunal. Where a Form 7 was filed and granted, the tenant became the occupant and the former landlord ceased to hold. A pending claim leaves the position unresolved. Neither appears on an Encumbrance Certificate, so a chain that looks clean on the registration record can still be defeated by a tribunal order nobody searched for.

What it does not prove

A clean Encumbrance Certificate says nothing about a tenancy claim, because a tribunal proceeding is not a registered instrument.
