Sale Deed
Also known as: conveyance deed, absolute sale deed
A sale deed is the registered instrument that actually transfers ownership of immovable property from seller to buyer in exchange for a price.
Under the Transfer of Property Act and the Registration Act, a sale of immovable property worth more than one hundred rupees is only effective when made by a registered instrument. The sale deed records the parties, the property, the consideration, and the covenants of title. It is the primary evidence of ownership and the document a title search is ultimately reading.
- What it proves
- Transfer of ownership, provided the seller had good title to convey.
- What it does not prove
- A registered sale deed does not cure a defect in the seller's own title. Registration proves the document was executed and recorded, not that the seller had the right to sell.
