Gift Deed

Also known as: settlement deed

A gift deed transfers ownership of property voluntarily and without consideration, and it must be registered to be effective for immovable property.

Acceptance by the donee during the donor's lifetime is essential; a gift not accepted is void. Gifts within a family are common in Indian title chains and are entirely valid, but they attract scrutiny where they appear designed to defeat an heir's claim or a creditor, and a conditional gift with unmet conditions can be revoked.
