Release Deed

Also known as: relinquishment deed

A release deed is an instrument by which a co-owner gives up their share in jointly-held property in favour of the other co-owners.

It operates only between existing co-owners - a release in favour of a stranger is in substance a sale or gift and will be treated as such for stamp duty. Release deeds appear constantly in Indian family property chains, and the recurring diligence question is whether every co-owner with a share actually joined in the release, since one omitted sibling leaves an outstanding undivided interest.
